Terms of Service — Circuit Party Info

Welcome to Circuit Party Info (“the App,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Circuit Party Info mobile application and related services. By using the App, you agree to these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using Circuit Party Info, you agree to be bound by these Terms. If you do not agree, do not use the App. We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you meet this age requirement. The App is intended for users interested in nightlife and circuit party events, which are adult-oriented activities.

3. Account Registration (Optional)

3.1 Creating an Account

• You may use the App without creating an account (local-only mode)
• Creating an account is optional and enables cloud sync, cross-device access, and additional features
• You must provide accurate information: display name, email address, birthday (for age verification), and a secure password
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access to your account

3.2 Account Responsibilities

• One account per person; you may not share your account
• You are responsible for all activity under your account
• You may not use another person’s account without permission
• You may not create an account using false information or impersonate another person

3.3 Account Termination

• You may delete your account at any time by contacting us at contact@circuitpartyinfo.com
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your right to use the App ceases immediately
• We will delete your account data within 30 days of deletion, except where retention is required by law

4. Description of Service

Circuit Party Info provides:

• Event discovery and calendar for circuit parties and nightlife events
• DJ lineup information and search functionality
• Event reminders and notifications
• City-based event filtering
• Ability to save favorite events and DJs (with account)
• Links to external event pages, ticket vendors, and social media

5. User Conduct

You agree NOT to:

• Use the App for any illegal purpose or violate any laws
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the App, other accounts, or computer systems
• Use automated tools (bots, scrapers) to access the App without permission
• Reverse engineer, decompile, or disassemble any part of the App
• Transmit viruses, malware, or harmful code
• Impersonate any person or entity
• Use the App to distribute spam or unsolicited messages
• Violate any third-party rights, including intellectual property and privacy rights

6. Content and Intellectual Property

6.1 Our Content

• All content in the App (text, graphics, logos, software, event data) is owned by Circuit Party Info or licensed to us
• Event information, flyers, and DJ names are used for informational purposes under fair use or with permission
• You may not copy, modify, distribute, or create derivative works from our content without permission
• “Circuit Party Info” name and logo are trademarks of CircuitPartyInfo LLC

6.2 Third-Party Content

• Event flyers, images, and descriptions are owned by event promoters and venues
• Links to ticket vendors, social media, and event pages are provided for convenience
• We are not responsible for third-party content or the accuracy of external information

6.3 User-Generated Content

• Any display name or preferences you provide remain your property
• By using the App, you grant us a license to use this information to provide the service
• You represent that you have the right to provide any information you submit

7. Event Information Disclaimer

7.1 No Guarantee of Accuracy

• Event information is provided for informational purposes only
• We source event data from third parties (social media, promoter websites)
• Events may be cancelled, rescheduled, or have incorrect details
• We are not responsible for event changes, cancellations, or inaccuracies
• Always verify event details directly with the promoter or venue before attending

7.2 Not a Ticket Vendor

• We do not sell tickets or handle ticket transactions
• Links to ticket vendors are provided as a convenience
• We have no control over ticket pricing, availability, or validity
• Ticket purchases are subject to the vendor’s terms and conditions

7.3 No Affiliation

• We are not affiliated with, endorsed by, or sponsored by event promoters, venues, or artists unless explicitly stated
• We are an independent event discovery platform

8. Push Notifications

• You may opt in to receive push notifications about events in your selected cities
• Notifications are sent via OneSignal and are subject to device settings
• You can disable notifications at any time in your device settings or within the App
• We are not responsible for failed or delayed notifications

9. Privacy and Data

Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

10. Third-Party Services

The App integrates with third-party services:

• Firebase (Google): Analytics, authentication, cloud storage
• OneSignal: Push notifications
• WordPress backend: Event data source

Your use of these services may be subject to their respective terms and privacy policies. We are not responsible for third-party services or their practices.

11. Disclaimers

11.1 “AS IS” Service

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Warranty

• We do not warrant that the App will be uninterrupted, error-free, or secure
• We do not warrant the accuracy, completeness, or reliability of any content
• We do not warrant that defects will be corrected
• Use of the App is at your own risk

11.3 Event Attendance

• We are not responsible for your attendance at events, your safety, or any incidents that may occur
• Circuit party and nightlife events may involve adult content, alcohol, and other age-restricted activities
• You are responsible for your own conduct and safety at events

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL
• OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICHEVER IS GREATER)

This limitation applies to any claims arising from:

• Use or inability to use the App
• Event cancellations, changes, or inaccuracies
• Unauthorized access to your account or data
• Any other matter relating to the App

Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Circuit Party Info, CircuitPartyInfo LLC, and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your attendance at events discovered through the App

14. Modifications to the App

We reserve the right to:

• Modify, suspend, or discontinue any part of the App at any time
• Change pricing for any premium features (with notice)
• Impose limits on features or storage
• Update these Terms

We will provide notice of material changes when reasonably possible.

15. Termination

We may terminate or suspend your access to the App immediately, without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Any reason at our sole discretion

Upon termination:

• Your license to use the App ends immediately
• We may delete your account data (subject to our Privacy Policy and legal obligations)
• Sections that by their nature should survive (disclaimers, limitations of liability, indemnification) remain in effect

16. Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of the District of Columbia within the United States of America, without regard to conflict of law principles.

17. Miscellaneous

17.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Circuit Party Info regarding the App.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

17.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign these Terms. We may assign our rights and obligations to any party.

17.5 Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control (natural disasters, pandemics, internet outages, etc.).
